Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus, directing the respondents to pay Family Pension to the petitioner in view of the death of her husband Bennimeen, who was working as Village Assistant who died in harness on 25.9.2001 by considering the representation dated 16.5.2012. ----- For petitioner :

Heard the learned counsels appearing on behalf of the parties concerned.

2. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if this Court passes an order directing the 2nd respondent to pass orders on the representation https://hcservices.ecourts.gov.in/hcservices/

made by the petitioner, dated 16.5.2012, within a time frame.

3. The learned counsels appearing on behalf of the respondents have no objection for such an order being passed by this Court.

4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the 2nd respondent is directed to pass orders on the representation made by the petitioner, dated 16.5.2012, within a period of twelve weeks from the date of receipt of a copy of this order, after giving an opportunity of hearing to the petitioner, as well as the other persons concerned, if any. The petitioner is directed to furnish a copy of the representation, dated 16.5.2012, to the 2nd respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

5. Accordingly, the Writ Petition is disposed of, with the above directions. No costs.
