ORDER

Petition seeking bail in respect of Spl S.C.No.74 of 2023 on the file of the Sessions Court, Magalir Neethi Mandram, (Fast Track Mahila Court), Erode in respect of Crime No.9 of 2023 on the file of the respondent police registered for the offences punishable under Sections 5(m), 5(n), 5(l), 5(j) r/w 6 of POCSO Act and Section 506(i) of IPC, is on board for consideration.

2. The learned counsel for the petitioner submitted that the petitioner has been incarcerated for more than 3 years and that the trial has not been completed so far. He further submitted that the petitioner has also filed an application seeking to recall the witness since the earlier Advocate had not given proper legal advice. He also submits that major part of the trial has been completed and the petitioners are ready to abide by any stringent condition that may be imposed by this court.

3. The learned Govt Advocate (Crl.Side) submitted that the petitioner who is the step-father of the victim girl, had committed penetrative sexual assault on the victim girl and the victim girl had passed away by committing suicide. The earlier bail application was dismissed and now the case is posted for arguments and he would thereby vehemently oppose for the grant of bail to the petitioner.

4. Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, taking into consideration that the trial is at the fag end, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 28-04-2026 SHL
