ORDER

This Criminal Original Petition has been filed to transfer CMP.No.66 of 2014 from the file of the Special Judicial Magistrate for Land Grabbing Case, Salem, to the file of the Judicial Magistrate No.VI, Salem.

2. The petitioner has lodged a private complaint as against the respondents herein under Section 200 of Cr.P.C., to take cognizance for the offence under Sections 120 (b), 417, 420, 423, 463, 464, 465, 467, 468 of IPC. Since the very constitution of the Special Court for Land Grabbing is under challenge before the Hon'ble Supreme Court of India, the learned Special Court could not able to take the complaint on file and it is pending from the year 2014 onwards. Therefore, the petitioner has sought for transfer of the said complaint to the other jurisdictional court.

3. Considering the abovesaid submission, the petition is ordered and the CMP.No.66 of 2014 is hereby withdrawn from the file of the Special Court for Land Grabbing Case, Salem and transferred to the file of the Judicial Magistrate No.VI, Salem, for further proceedings.

4. With the above direction, this Criminal Original Petition is allowed.
