O R D E R

The Criminal Miscellaneous Petition is filed to modify the conditional order passed by this Court vide order dated 26.02.2020 in Crl.M.P.No.116 of 2020 in Crl.R.C.No.20 of 2020 that "The petitioner shall deposit a sum of Rs.1,50,000/- (Rupees One Lakh and Fifty Thousand only) before the Trial Court in the respective calender cases, viz., 709 and 710 of 2009, with in four weeks from the date of receipt of a copy of this order".

2.The learned counsel for the petitioner submitted that the petitioner/accused was acquitted by the Trial Court against which the respondent preferred an appeal before the Sessions Court. The Sessions Court reversed the order of acquittal and convicted the petitioner against which the present Revision. In the revision the petitioner filed Crl.M.P.No.116 of 2020, seeking suspension of sentence.

This Court by order dated 26.02.2020 suspended the sentence and directed the respondent to deposit a sum of Rs.1,50,000/- before the Trial Court in C.C.Nos.709 and 710 of 2009 within a period of four weeks from the date of receipt of the order. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel further submitted that before the completion of four weeks, due to Covid-19 all the Courts were closed from 23.03.2020 and he was unable to deposit the said amount. The petitioner is now ready with the amount and he seeks small accommodation to deposit the same.

4.In view of the same, this Court inclined to grant extension of time to deposit the said amount. Hence, the petitioner is directed to deposit the amount as per the order of this Court dated 26.02.2020 in C.M.P.No.116 of 2020 in Crl.R.C.No.20 of 2020 on or before 19.01.2021. It is made clear that no further extension would be entertained.
