Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to dispose of the petitioner's representation dated 03.06.2020 to remove the excess land measuring to an extent of 1150 sq.ft from patta bearing No.2571 comprised in Survey Nos.80/1A1B and 80/2B3 and issue patta for the land measuring to an extent of 450 sq.ft. comprised in Survey No.80/1A1B and 80/2B3 in the same patta only and issue to combine Patta Bearing No.2575 for the land measuring 675 sq.ft comprised in Survey No.80/2B2 in favour of the petitioner's name measuring to a total extent of 1125 sq.ft. For the Plot No.G as per in CMDA approval No.1585/14-15 dispatched No.6682/14 dated 19.02.2015, patta in the petitioner's name within a time frame as may be fixed by this Court.

O R D E R

This writ petition has been filed by the petitioner seeking for issuance of a writ of mandamus directing the second respondent to consider the representation made by the petitioner on 03.06.2020, wherein the petitioner has requested the second respondent to survey the land and to issue patta in respect of the subject property.

2. Mr. Annai Ezhil, learned Government Advocate appearing on behalf of the respondents, based on the written instructions received from the second respondent, submitted that the second respondent has fixed the date of enquiry on 12.10.2020 at 11.00 am. He further submitted that the petitioner can be present for the enquiry along with the relevant documents.

3. Taking into consideration the facts and circumstances of the case and also considering the fact that the second respondent has already called the petitioner for an enquiry, there shall be a direction to the second respondent to deal with the representation of the petitioner, dated 03.06.2020, strictly in accordance with law and take a decision within a period of four weeks from the date of receipt of a copy of this order.

4. This writ petition is disposed of, with the abovesaid directions. No costs.
