This writ petition has been filed for issue of a writ of mandamus directing the second respondent to act upon the online 3/6

application submitted by the petitioner dated 02.09.2024, wherein the petitioner is seeking for survey of the subject property and for demarcation of boundaries in order to fence the property.

2. Heard the learned counsel for the petitioner, the learned Special Government Pleader for the respondents 1 to 4 and the learned Government Advocate for the respondents 5 and 6.

3. The petitioner is placing reliance upon the gift-cumsettlement deed dated 02.03.2017 and also the partition deed dated 06.04.2023. The petitioner is also placing reliance upon the summons issued by the second respondent dated 14.10.2024 and 18.11.2024 pursuant to the submission of online application. The petitioner is also placing reliance upon the patta in Patta Nos.1685 and 72. The grievance of the petitioner is that the second respondent never took a decision and the second respondent has in fact sought for police protection with 6th respondent and thereafter, there was no progress.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to act upon the online application dated 02.09.2024 and take a decision with regard to survey of the subject property within a period of four weeks from the date of receipt of a copy 4/6

of this order. If there are any interested parties, such survey shall be conducted in their presence.

The Writ Petition is disposed of in the above terms. There shall be no order as to costs.
