ORDER
The Writ Petition has been filed seeking a direction to the second respondent police to provide adequate police protection to the petitioner to use the cart track to access land for agricultural activities by them and associated workers or vehicles, as well as to transport agricultural products from the petitioners land to the main road.
2.The petitioner is owning agricultural lands comprised in Survey Nos.68/1A, 68/1B and 57/1B situated at Pirithi Village, Tiruchengode Taluk, Namakkal District. There exists a well-defined and long-standing cart track (common pathway) which is running through the S.Nos.68/4A1, 4A2, 2A, 2B, 2C and 3C. The petitioner arranged for transporting his agricultural produce through the subject cart track. While so, the respondents 3 to 5 obstructed the common pathway using JCB, heavy iron pipes and stones. Hence the petitioner lodged a complaint to the second respondent, but no action has been taken. Hence, the above writ petition.
3.The learned Additional Public Prosecutor submitted that pursuant to the petitioner's complaint, CSR No.16 of 2026 assigned. Both the petitioners and counter petitioners/respondents 3 to 5 were called for enquiry. Both appeared and agreed that common pathway will not be obstructed without any orders from the Court or any competent authority. Recording the same, the complaint was closed on 09.03.2026. As on date, there is no obstruction and the petitioner can use the common pathway and transport his agricultural produce. 4.Recording the submission of the learned Additional Public Prosecutor, the Writ Petition is disposed of.
