Crl.M.P.No.6035 of 2020 in Crl.A.Sr.No.25613 of 2020 M.NIRMAL KUMAR.J., This petition has been filed to condone the delay of 715 days in filing the Criminal Revision Petition.

2.The petitioner has filed a private complaint in C.C.No.231 of 2017 against the respondent. The Trial Court by judgment dated 31.01.2018 had dismissed the complaint and discharged the respondent. Against which the present Appeal.

3.Though notice was served and Mr.C.A.Prabhakaran, learned counsel for the respondent name printed in the cause list, there is no representation on behalf of the respondent.

4.The learned counsel for the petitioner submitted that the Trial Court had dismissed the complaint on technicalities and not on merits. Further, he voluntarily submitted that the petitioner is willing to deposit a cost of Rs.25,000/- to Rajiv Gandhi Government General Hospital, without prejudice to his rights.

M.NIRMAL KUMAR.J., rst 5.Considering the submission made by the learned counsel for the petitioner and the averments made in the affidavit filed in support of the petitioner, the delay of 715 days is condoned on payment of cost of the Rs.25,000/- to the (Rupees Twenty Five Thousand only) as non-refundable deposit through RGS/NEFT in favour of the "The Dean, Rajiv Gandhi Government General Hospital, Chennai, bearing A/c. No.10273425961, State Bank of India, Park Town (Chennai), 68, Evening Bazaar Road, Chennai, IFSC:SBIN0001856, within one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court.
