The petitioner, who arrested and remanded to judicial custody on 07.11.2024 for the offences punishable under Sections 8(c)r/w 20(b)(ii)(C), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.54 of 2024 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner herein was arrested in connection with transporting 42kgs of ganja from Andhra Pradesh. The petitioner was intercepted at Chennai, where he was arrested and also contraband was seized from him.

3.The learned counsel appearing for the petitioner states that the petitioner is an innocent person and nothing was seized from this petitioner. The said 42 kgs of ganja was seized from the first accused. 4.The learned Government Advocate (Crl.Side) filed a detailed counter wherein he has stated that on the direction of A3, A1 had gone to Andhra Pradesh to procure 42 kgs of ganja, which was transported to Chennai through a container lorry. This petitioner is knowing well that the transporting 2/4

of narcotic drugs were being transported in his truck, carried the contraband from Andhra Pradesh to Chennai and it was proceeding towards Madurai to deliver it to A3. The said 42 kgs of ganja was seized from the lorry container. The statement of the petitioner as well as A1 disclose their culpability in the crime. Considering the embargo under Section 37 of the NDPS Act, this Criminal Original Petition stands dismissed.
