ORDER

This Criminal Original Petition is filed to call for the records pertaining to the charge sheet in C.C. No.1 of 2014 on the file of the Special Court under TNPID Act, 1997 at Madras and quash the same as illegal.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent.

It is seen that this petitioner had filed Crl.O.P. No.32611 of 2014 for the same relief and this Court, by a detailed order dated 29.04.2015, dismissed the said petition holding that the prosecution against the petitioner in C.C. No.1 of 2014 pending on the file of the Special Court for TNPID Act cases, cannot be quashed, as there are several materials against the petitioner. Suppressing the same, the petitioner has filed the present quash petition engaging another advocate. https://hcservices.ecourts.gov.in/hcservices/

When this was brought to the notice of the learned counsel for the petitioner, he conveyed his apology and regret and sought permission to withdraw this petition. As noted by this Court, there are sufficient materials against the petitioner for the trial to proceed against him in C.C. No. 1 of 2014.

In view of the above, the learned counsel for the petitioner is permitted to withdraw this petition and accordingly, this Criminal Original Petition is dismissed as withdrawn. Connected Crl.M.Ps. are closed.
