This application has been taken out by the defendants in the suit seeking a summary judgment of dismissal of the suit on the ground that the Bank had already approached the Debt Recovery Tribunal and it obtained an order in O.A.No.246 of 2010. It is also stated that dis-satisfied with the said order, the Bank has also filed R.A.No.38 of 2017 before the Debt Recovery Appellate Tribunal, Chennai.

2. Pending this application, the learned Senior Counsel appearing for the State Bank of India has served copy of the order of the Debt Recovery Appellate Tribunal on Mr.M.B.Raghavan, learned counsel appearing for the applicants in this application, which is to the effect that the O.A.No.246 of 2010 filed by the Bank before the Debt Recovery Tribunal stands dismissed as withdrawn. Therefore, the very basis of this application no longer survives.

3. Hence, this application is dismissed.
