Crl.O.P.No.11480 of 2024 and Crl.M.P.Nos.12204, 10246, 8015 of 2024 P. DHANABAL,J The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420 r/w 120B IPC, in Crime No.45 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. There are totally seven accused in this case and the petitioner is arrayed as A2. The case of the prosecution that all the accused jointly assured the defacto complainant to convert the patta of a land which belongs to SIPCOT to the defacto complainant's trust which is running a school. To cancel the patta which stands in the name of SIPCOT, the accused assured to get an order from the Government officials and they demanded money for that purpose. A1 undertakes to transfer the patta which stands in the name of SIPCOT to the trust. Believing his words, the defacto complainant has paid various amounts on various occassions which come around Rs.6 Crores. According to the defacto complainant, the said sum of Rs.6 Crores belongs to the trust.

3. The learned counel appearing for the petitioner submitted that the petitioner has not received any amount from the defacto complainant and A1 only received the entire amount. The petitioner is innocent and he has been falsely implicated in this case. He further submitted that already this Court vide common order dated 12.06.2024 in Crl.O.P.Nos.11480, 11533, 11529 & 11532 of 2024 had granted interim bail to the petitioner and others on condition that each of the petitioners have to deposit a sum of Rs.20,00,000/- to the credit of Crime No.45 of 2024 within a period of four weeks from the date of receipt of a copy of that order and the said condition has been complied with by the petitioner. Hence the interim anticipatory bail granted to the petitioner may be made absolute.

4. Learned Government Advocate (Criminal Side) appearing for the respondent has not raised any serious objection and also submitted that the conditional order of this Court dated 12.06.2024 in Crl.O.P.No.11480 of 2024 has been complied with by the petitioner.

5. Learned counsel for the intervenor has also admitted that the petitioner has complied with the conditional order of this court and he has also not raised any serious objection to grant anticipatory bail to the petitioner.

Considering the submissions of both sides, the nature of offence and already this Court granted interim anticipatory bail to the petitioner and the conditional order of this Court dated 12.06.2024 has been complied with by the petitioner and also considering the fact that no previous case is pending as against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner and hence, the interim anticipatory bail already granted to the petitioner vide order dated 12.06.2024 is made absolute. Consequently, connected miscellaneous petitions are closed. 13.09.2024 ( 1/2) mfa
