Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to appoint the petitioner as Office Assistant in the sanctioned post in the 3rd respondent college, so as to enable the petitioner to get her service regularised in the cadre of office assistant with all service and monetary benefits within a time limit that may be fixed by this Court.

By consent, the writ petition is taken up for final disposal. The petitioner, though completed 9th standard, did not pass SSLC and she discontinued the school education in the midway and got her name registered in the District Employment Exchange, Vellore, vide W/10028/90/85 dated 13.12.1993 and based on her employment exchange seniority, her name was sponsored for employment to the services of the 3rd respondent College and she has also attended the interview and vide proceedings dated 08.12.1998, she was appointed as "Ayah-cum-Scavenger" on daily wage basis. The petitioner claims that she is in regular employment in the said post right from her date of appointment and since her services have not been regularised in spite https://hcservices.ecourts.gov.in/hcservices/
of rendering long years of service and in this regard, she has submitted a representation dated 29.08.2015 to the 2nd respondent and since no orders have been passed, the petitioner came forward to file this writ petition.
Learned counsel for the petitioner would submit that the 3rd respondent, vide letter in Na.Ka.No.358/m/2001 dated 18.04.2001 addressed to the 2nd respondent, has informed that the sanctioned post of "Ayah" is absolutely necessary . However, the 2nd respondent did not take any action on the said proposal mooted out by the 3rd respondent and hence, prays for appropriate orders. Heard the submissions of Mr.S.Gunasekaran, learned Government Advocate who accepts notice on behalf of the respondents. Though the petitioner has sought for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 29.08.2015 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
