The petitioner who is a tenant under the 1st respondent herein has filed this petition seeking to extend two months time for vacating the property which is the subject matter of Execution Proceedings in C.P.No.186 of 2013 in R.C.O.P.No.288 of 2011 on the file of XV Small Causes Court at Chennai stating that the petitioner's mother lived in the said house for several years and her first year ceremony may be permitted to be conducted in the said property.

2. It is pertinent to note that in C.R.P.No.3701 of 2023 dated 01.11.2023, based on the affidavit of the petitioner S.Vijaya, seven months time was granted to vacate the premises i.e on or before 31.05.2024.

3. Ms.R.V.Rukumani, learned counsel appearing for the respondents would stoutly contend that the 1st respondent is 98 years old and from the year 2011 by filing R.C.O.P., he has been contesting proceedings one after Page No.1/3

another.
