Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records relating to the issuance of the order in reference in Na.Ka.No.9584/2017/Chaoothi-1, dated 04.10.2017 of the first respondent herein and quash the same as illegal and further direct the respondents to retain him as a Noon Meal Organizer in the Existing Working Place at Government Boys Higher Secondary School, Adhamangalam Village, Kalasappakkam Taluk, Thiruvannamalai District itself.

O R D E R

By way of filing this writ petition, the petitioner seeks to quash the impugned order of transfer dated 04.10.2017 passed by the first respondent transferring him from Aadhamangalam Village, Kalasappaakkam Taluk, Thiruvannamalai District, to Government Panchayat Primary School, Gidaampalayam Village, Thiruvannamalai District. It is also stated in the impugned order that the petitioner was transferred to the said place only after receiving his request.

2. When the matter is taken up, learned Additional Government Pleader appearing for the respondents 2 and 3 stated that the respondents have have recalled the impugned transfer order and thereafter, they have also passed fresh transfer order citing administrative grounds.

3. In view of the above, the writ petition is dismissed giving liberty to the petitioner to challenge the subsequent transfer order if he is so advised. No Costs.
