A. Nos.6960 and 6961 of 2017 in C.S.No.939 of 2016 M.SUNDAR.J., Both these applications have been taken out with prayers to bring on record Legal representatives of deceased fourth defendant i.e., Late Sri.Raghavan and add them as Defendants 9 to 11.

2. Though there is no dispute that respondents 1, 2 and 3 herein are legal heirs of deceased Defendant No.4, Mr.R.Raghavan, considering the nature of the matter and issues which arise in this lis by consent of all the parties, all question pertaining to the rights of the legal heirs qua trade marks, which are subject matter of this suit, who are now being impleaded, should be left open to be decided in the interlocutory applications and/or the main suit depending on the discretion of this Court.
