ORDER

This Writ Petition has been filed seeking for a Writ of Certiorari, to call for the records from the 1st respondent relating to the decision proceedings of the 1st respondent based on attendance review dated 16.04.2024 and all consequential proceedings disallowing the petitioner to sit for end semester examinations of II semester as his average attendance stands for 52% and quash the same as illegal, bias, arbitrary, against natural justice.

2. The case of the petitioner is that, he is a 1st year student of MBA in the 1st respondent's College. Due to the participation in the sports events and physical illness, he is having 52 percentage of attendance. However, the 1st respondent had issued the impugned order dated 16.04.2024 disallowing the petitioner to sit for end semester examinations of 2nd semester as his average attendance stands at 52 percentage. Challenging the same, the petitioner has filed the present writ petition before this court. Page No.2 of 4

When the matter is taken up for hearing today, learned counsel for the petitioner submits that, pursuant to the directions issued by this court, the petitioner had participated in the examinations. Therefore, he submitted that the respondents may be directed to publish the result and permit the petitioner to attend the classes and if the petitioner satisfies the necessary attendance, the respondents may be directed to permit the petitioner to sit in the future examinations.

4. Considering the limited request made by the learned counsel for the petitioner, this court, without interfering with the impugned order, directs the respondents to publish the result and permit the petitioner to attend the classes regularly. Further, the respondents are directed to permit the petitioner to sit for the future examinations, if he satisfies the necessary attandance.
