Heard Mr.T.Arockiadoss, learned counsel for the petitioners and Mr.M.L.Mahendran, learned Government Advocate appearing for the respondents and with their consent, the writ petition is disposed of at the admission stage itself.
2.The petitioner seeks for issuance of a writ of mandamus to direct the 1st respondent to dispose of the petitioner's appeal dated 27.01.2014.
3.The petitioner filed a representation before the Special Tahsildar, Tambaram, on 22.01.2014 to take appropriate action and rectify the wrong entries in the patta in respect of the lands in Survey No.209 [part], Pallikaranai, Jaladianpet. The 2nd respondent, by communication dated 22.01.2014, directed the petitioner to file an appeal before the 1st respondent. The petitioner has filed an appeal https://hcservices.ecourts.gov.in/hcservices/
on 27.01.2014, which has been received by the office of the 1st respondent as evidenced from the date seal affixed in the copy of the representation. Though the petitioner had stated that wrong entries have been made in the patta, the petitioner has not named those persons in whose names the patta stands as on date and they have not been impleaded as respondents in this writ petition. Therefore, no writ of mandamus as sought for by the petitioner, can be issued in this writ petition. However, since an appeal is pending before the 1st respondent, there will be a direction to the 1st respondent to consider the petitioner's appeal dated 27.01.2014 and pass orders on merits and in accordance with law as expeditiously as possible, after issuing notice to all the parties including the petitioner herein. 5.The writ petition is disposed of with the above direction. No costs.
