2 B.SAMUVEL DURAI PANDIAN Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit to withdraw a sum of Rs,4,67,833/- being the 50% of the Award amount together with interest thereon and pass such further or other orders as this Hon'ble court may deem fit and proper in these circumstances of the case and thus render justice(in CMP.No.19029/2017) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.SANKARANARAYANAN, Advocate for the petitioner and of M/S.M.SUNDARRAJA MUKUND.M Advocate for the 1st respondent and of M/S.SENTHOOR PANDIAN, Advocate for the 2nd respondent the court made the following order:- This petition is filed to permit the petitioner herein to withdraw the sum of Rs.4,67,833/- being the 50% of the award amount together with interest there on.
2. It is seen from the order of this court dated 20.03.2017 passed in M.P.No.01 of 2015 that the appellant/Insurance company was directed to deposit 50% of the award amount.
3. In view of the submissions made by the learned counsel appearing on behalf of the petitioner/claimant this Court is inclined to permit the petitioner to withdraw entire amount deposited(50% of the deposited award amount) by the appellant/Insurance company lying in the credit of M.C.O.P.No.3925 of 2012 before the Tribunal.
4. This petition is ordered accordingly.
