Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus directing the fourth to sixth respondents to not to construct any canal or road in the petitioner private property situated at Dalavoy Pattadai Village, Pallipattu Taluk, Tiruvallur District, comprised in Survey No.115/11 to an extent of 18 1⁄2 cents, Survey No.115/6A & as per Patta S.No.115/6A1 to the extent of 0.46 cents and Survey No.115/6A and as per Patta S.No.115/6A2 to the extent of 0.34 cents measuring altogether to the extent of 98 1⁄2 cents without following any rules and procedure. The relief sought by the petitioner in this writ petition is to direct the fourth to sixth respondents to not to construct any canal or road in the petitioner private property situated at Dalavoy Pattadai Village, Pallipattu Taluk, Tiruvallur District, comprised in Survey No.115/11 to an extent of 18 1⁄2 cents, Survey No.115/6A & as per Patta S.No.115/6A1 to the extent of 0.46 cents and Survey No.115/6A and as per Patta S.No.115/6A2 to the extent of 0.34 cents measuring altogether to the extent of 98 1⁄2 cents without following Page No.2 of 5
any rules and procedure.
2. When the matter was taken up for hearing, learned counsel for the petitioner submitted that the matter has become infructuous and nothing survives in this writ petition for further adjudication. He has also made an endorsement to that effect in the case bundle.
3. In view of the submission coupled with an endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
