O R D E R

This Writ Petition has been filed challenging the order in Na.Ka. No.1531/2018(c) dated 23.04.2019, passed by the Third Respondent.

It is brought to the notice of this Court by the Learned Counsel for the Petitioner that the Petitioner during the pendency of the Writ Petition, preferred a Statutory Appeal under the provisions of the Patta Pass Book Act against the same order and as such seeks leave of this Court to withdraw the Writ Petition with liberty to pursue the said Appeal. https://hcservices.ecourts.gov.in/hcservices/

Learned Additional Government Pleader appearing for the First to Fourth Respondents states that the date of hearing of the appeal has been fixed on 27.08.2019, before the Second Respondent.

The Second Respondent shall ensure that notice is issued in advance to all parties concerned and there is atleast one effective hearing every week conducted for speedy progress of the case. The Petitioner shall co-operate for the earlier disposal of the same. It is needless to add here that after affording full opportunity of hearing to all the parties concerned, a reasoned order shall be passed, considering each of the contentions of the parties and decision taken shall be communicated to them under written acknowledgment. 5.

Accordingly, the Writ Petition is dismissed as withdrawn, granting such liberty. No Costs.
