Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus directing the 1st respondent herein to consider petitioner's representation dated 09.07.2021 and appoint another Enquiry Officer in respect of the enquiry pursuant to the letter dated 05.07.2021 in na.Ka.No.2042/2021 APA[5] of the 2nd respondent herein.

ORDER

By consent, the writ petition is taken up for final disposal and disposed of by this order.

Mr.L.P.Shanmugasundaram, learned Standing counsel accepts notice on behalf of the respondents 1 and 2.

The petitioner had filed the present writ petition seeking for a mandamus to direct the 1st respondent to dispose of the petitioner's representation dated 09.07.2021 seeking appointment of another Enquiry Officer pursuant to the letter of the 2nd respondent dated 05.07.2021.

This Court heard the submissions of the learned counsel for the petitioner and the learned Standing counsel https://hcservices.ecourts.gov.in/hcservices/

appearing for respondents 1 and 2 and also perused the materials placed.

This Court, considering the limited scope of prayer sought for by the petitioners and without expressing any opinion on the merits of the petitioner's representation or the case projected by him in this writ petition, directs the 1st respondent to consider and dispose of the petitioners' representation dated 09.07.2021 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners herein and till such time the representation of the petitioner is considered on merits, the respondents are directed to postpone the enquiry. 6.

The writ petition stands disposed of accordingly. No costs.
