..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the first respondent to implement his own proceedings bearing in Na.Ka.No.7074/2023/A10 dated 25.10.2023 for laying road comprised in Survey Nos.499/4A and 499/4B situated at Sevanvalau, Mattaiyampatti, Desavilakku, Salem District and subsequently, grant police protection to access the road by the petitioner and other villagers.

ORDER

This writ petition has been filed seeking for a direction to the first respondent to implement his own proceedings dated 25.10.2023 for laying road in the property more fully disclosed in the prayer to this writ petition and subsequently, grant police protection to access the road by the petitioner and other villagers based on the petitioner's representations dated 22.02.2024 and 02.04.2024 within a time frame to be fixed by this Court.

2. According to the petitioner, despite the proceedings of the first respondent dated 25.10.2023 agreeing to lay road in the property more fully disclosed in the prayer to this writ petition, the respondent has not laid the said road. In such circumstances, the petitioner had given representations to the respondents 2 and 4 on 22.02.2024 and 02.04.2024 respectively. Since the same has not been considered, the petitioner has filed this writ petition.

3. Ms.C.Meera Arumugam, learned Additional Government Pleader, accepts notice for the respondents 1, 2 and 4. Mr.V.Meganathan, learned Government Advocate [Crl.side], accepts notice for the third respondent.

4. No prejudice would be caused to the respondents if the petitioner's representation, as stated supra, is considered on merits and in accordance with law by the first respondent in the light of the proceedings of the first respondent dated 25.10.2023 with regard to laying of road in the property more fully disclosed in the affidavit filed in support of this writ petition within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this writ petition is disposed of by directing the first respondent to consider implementing his own proceedings dated 25.10.2023 in respect of laying of road in the property more fully disclosed in the affidavit filed in support of this writ petition based on the petitioner's representations dated 22.02.2024 and 02.04.2024 within a period of twelve (12) weeks from the date of receipt of a copy of this order.
