ORDER
Mr.L.Jai Venkatesh, learned counsel on record for the sole writ petitioner and Mr.R.P.Pratap Singh, learned Government Advocate on behalf of respondents 1 and 2 and Ms.K.Bhuvaneswari, learned Additional Government Pleader for 3rd respondent i.e., The Executive Officer, Thirumurugan Town Panchayat, Avinashi Taluk, Tiruppur, are before this Court.
2.With the consent of all the three learned counsel, the main writ petition itself is being taken up, heard out and is being disposed of.
3.The prayer is extremely narrow.
4.The prayer is for a Mandamus for disposal of a representation dated 07.05.2019 sent by the petitioner requesting the local authority to levy property tax after assessing the petitioner's residential house at Plot No.132, Duraisamy Nagar, Rakkiyapalayam, Avinashi, Thirumuruganpoondi, Tiruppur.
5.Though the prayer in the writ petition seeks a mandamus against all the respondents, considering the nature of the request in the aforesaid representation, this Court is informed that it would be desirable to mandamus the 3rd respondent to dispose of the representation, as the 3rd respondent is the authority concerned with regard to levy of property tax. 6.In the light of the narrative supra, the following order is passed:
a) The 3rd respondent in the instant writ petition i.e.,The Executive Officer, Thirumurugan Town Panchayat, Avinashi Taluk, Tiruppur, is directed to consider and pass orders on the representation dated 07.05.2019 (annexed to the typed set of papers at pages 17 to 19) in a manner known to law within a period of eight weeks from the date of receipt of a copy of this order.
b)On disposal of the representation, the 3rd respondent shall communicate the order passed disposing of the representation to the writ petitioner in a manner known to law under due acknowledgement within seven working days from the date of disposal of the representation.
This writ petition is disposed of on the above terms. There shall be no order as to costs.
