Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a writ of Certiorarified Mandamus, calling for the records pertaining to the order passed by the second respondent in his proceedings Na.Ka.No.3454/A4/2009 dated 06.07.2012 and quash the same insofar as non-payment of balance provident fund amount and the interest thereon for the belated payment and the amount payable and direct the respondents to pay the balance of provident fund amount (arrears of dearness allowance) and the interest for the entire amount from the date of retirement to till date. ORDER

The writ petition has been filed by the petitioner seeking for Certiorarified Mandamus Certiorarified Mandamus, calling for the records pertaining to the order passed by the second respondent in his proceedings Na.Ka.No.3454/A4/2009 dated 06.07.2012 and quash the same insofar as non-payment of balance provident fund amount and the interest thereon for the belated payment and the amount payable and direct the respondents to pay https://hcservices.ecourts.gov.in/hcservices/

the balance of provident fund amount (arrears of dearness allowance) and the interest for the entire amount from the date of retirement to till date.

2. Though the Petitioner has given a representation on 31.07.2012 and the same is pending without passing any orders by the second respondent/District Educational Officer, Cuddalore, Cuddalore District, the petitioner has prayed this Court seeking direction to the Respondents to pass orders on the representation dated 31.07.2012.

3. I Heard the submissions of Mr.P.Ganesan, learned counsel appearing for the petitioner and Mr.A.Rajaperumal, learned Additional Government Pleader for the respondents. 4.Without going into the merits of the case, this Court directs the second respondent to consider the petitioner's representation dated 31.07.2012 by giving personal opportunity to the petitioner and to pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. This Writ Petition is disposed of accordingly. No costs.
