ORDER

This writ petition has been filed challenging the order of suspension dated 23.03.2023 on the file of the second respondent.

2. The petitioner while he was working as a Field Surveyor, the petitioner was arrested and remanded into judicial custody in pursuant to the registration of an FIR in CC No.1 of 2022 for the offence punishable under Section 7(a) of the Prevention of Corruption (Amendment) Act, 2018. Subsequently, there was a raid in the petitioner's house and seized Rs.22,84,650/- by cash. Therefore, the petitioner was deemed to be suspended from service by order dated 23.03.2023. Now the charge sheet has been filed in criminal case and it is pending without examining any of the prosecution witnesses. Thereafter, the petitioner was served with charge memo only in the month of August, 2025. It is also pending without even appointing the enquiry officer. Therefore, the prolonged suspension of the petitioner can be reviewed in the light of the G.O.(Ms).No.81, Human Resources Management (N) Department dated 04.08.2022.

In view of the above, the second respondent is directed to review the order of suspension dated 23.03.2023, in the light of G.O.Ms.No.81, Human Resources Management (N) Department dated 04.08.2022 and place the petitioner in any one of the non sensitive post, till the completion of criminal case or disciplinary proceedings, within a period of four weeks from the date of receipt of a copy of this order.
