O R D E R

By consent, the Writ Petition is taken up for disposal at the stage of admission itself.

2. This Writ Petition has been filed to issue a Writ of Mandamus directing the respondents to transfer the Saw Mill license of Sri Angalamman Saw Mill from the 1st petitioner to 2nd petitioner, as per application dated 15.09.2011.

3. The learned counsel for the petitioners would submit that the petitioners are husband and wife respectively and the 1st petitioner is doing saw mill business after demise of his father. The said mill was registered with the 2nd respondent and subsequently the renewal of license was done in the name of the 1st petitioner periodically. The 1st petitioner propose to transfer the license to his wife, namely the 2nd petitioner for which the 1st petitioner has approached the respondents in-person and submitted the application to transfer the license to the 2nd petitioner. Since the said application has not been considered, the petitioners have come forward with this writ petition.

Mr.Manoharan, learned Government Advocate (Forest) takes notice for the respondents and would bring to the notice of this Court that the transfer of license is governed by the direction of the Hon'ble Supreme Court and as far as renewal is concerned, the respondents may be directed to consider the renewal of license.

5.Taking note of the submissions made by the learned Government Advocate (Forest), this Court is inclined to direct the respondents to consider the application of the petitioners for renewal and for transfer in accordance with law within a period of three months from the date of receipt of copy of this order.

6.The Writ Petition is disposed of accordingly. Consequently, connected miscellaneous petition is closed. No costs. 21.10.2016 Index : Yes / No Internet : Yes ssd
