Petitioner has filed the present petition seeking transfer of the H.M.O.P.No.3879 of 2009 pending on the file of the II Additional Judge, Family Court, Chennai to Subordinate Judge, Tambaram.

2. Learned counsel for petitioner submits that a petition seeking divorce filed by respondent/husband is pending on the file of learned II Additional Judge, Family Court, Chennai. As the major part of the cause of action is within the jurisdiction of Sub Court, Tambaram and the petitioner is also residing in the jurisdiction of Tambaram, the petitioner prays for transfer of H.M.O.P.No.3879 of 2009 pending on the file of learned II Additional Judge, Family Court, Chennai to learned Subordinate Judge, Tambaram.

3. Heard learned counsel for the petitioner. There is no representation for respondent.

4. Considering the submissions of the petitioner, this Court directs transfer of H.M.O.P.No.3879 of 2009 pending on the file of learned II Additional Judge, Family Court, Chennai to the file of learned Subordinate Judge, Tambaram.

5. The Transfer Civil Miscellaneous Petition, accordingly, is ordered. No costs. Consequently, connected miscellaneous petition is closed.
