PRAYER: Criminal Original Petition is filed under Section 439(1)(b) of Cr.P.C. praying to modify the onerous conditions of the bail order passed by the learned Principal Sessions Judge, Chengalpattu District in Crl.M.P.No.1055 of 2024 dated 29.04.2024 that the petitioner shall execute a bond for Rs.10,000/- with two sureties each (one of the surety should be blood relatives) and to deposit a sum of Rs.1,00,000/- into account of the learned Judicial Magistrate No.I, Tambaram concerned in Crime No.111 of 2021 of CCB, Team No.IV, Tambaram City. ORDER

Criminal Original Petition has been filed to modify the condition imposed by the Judicial Magistrate No.I, Tambaram in Crl.M.P.No.1055 of 2024 by order dated 29.04.2024 to execute a bond for Rs.10,000/- with two sureties each (one of the surety should be blood relatives) and to deposit a sum of Rs.1,00,000/-.

2. The learned counsel for the petitioner would state that since the petitioner had married out of caste, his relatives are not willing to help him to stand as surety. As regards the condition to deposit a sum of Rs.1,00,000/-, he is ready to deposit a sum of Rs.50,000/-. Hence, he seeks modification of these two conditions imposed by the learned Judicial Magistrate No.I, Tambaram in Crl.M.P.No.1055 of 2024 on 29.04.2024.

3. In view of that particular fact and in view of provisions of law, this Petition stands partly allowed and the said conditions are modified as follows:

"1.The petitioner/accused is ordered to be released on bail on his 2/4

execution of bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction of the Judicial Magistrate No.I, Tambaram. However, the deposit of Rs.1,00,000/- is concerned, I am not inclined to modify the same. All other conditions remains intact.
