Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the second respondent to make a substantial payment of the petitioner's money available in his hands in favour of the first respondent and consequently, forbearing the first respondent from proceeding on the petitioner's valuable properties pertaining to the sale notice dated 11.08.2015 proposed to be sold in public auction sale on 16.09.2015 or any other subsequent dates.

(delivered by SATISH K. AGNIHOTRI, J.) The learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file a fresh writ petition before a learned Single Judge and has also made an https://hcservices.ecourts.gov.in/hcservices/

endorsement to that effect as under:

"The writ petition may be dismissed as withdrawn with liberty to move a fresh writ petition before the learned Single Judge."
