The Criminal Revision filed under Section 397 read with 401 of Code of Criminal Procedure to set aside the order of acquittal dated 10.01.2013 in C.C.No.355 of 2009 passed by the learned Judicial Magistrate, Tiruchengode and allow the present criminal revision.

ORDER

The criminal revision has been filed against the order of acquittal dated 10.01.2013 made in C.C.No.355 of 2009 passed by the learned Judicial Magistrate, Tiruchengode. The defacto complainant has preferred the present revision against the order of acquittal. In view of the amendment dated 31.12.2009, appeal only lies against the order of acquittal impugned in this revision, and considering the fact that the defacto complainant has preferred the revision against the order of acquittal, this Court is inclined to transfer the present revision to the Sessions Judge, Namakkal. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, the present revision is hereby transferred to the Sessions Judge, Namakkal, and the learned Sessions Judge, is directed to take up the matter on file and re-number the same and thereafter dispose of the matter in accordance with law after giving due opportunities to both the parties. With the above direction, the criminal revision is disposed of.
