Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the first respondent to pass order on the petitioner's application dated 08.05.2015 for rectifying the mistakes and issue separate patta in the name of the petitioner viz., Sivakumar in respect of his property in S.Nos.100/3A3A & 100/3A3A1, to an extent of 3.25 Acres, situated at Veerakkal Pudur Village, Mettur Taluk, Salem District.

ORDER

This writ petition has been filed for the issuance of writ of mandamus directing the first respondent to pass orders on the application submitted by the petitioner on 08.05.2015, wherein, the petitioner wants rectification of the errors that has crept in, in the revenue records and for issuance of a separate patta in the name of the petitioner with respect of the subject properties.

The case of the petitioner is that after an application was submitted before the first respondent on 08.05.2015, the first respondent had directed the second respondent to conduct an enquiry and send the report in order to enable the first respondent to pass orders. The further case of the petitioner is that the second respondent directed the Revenue Inspector to conduct the enquiry and the Revenue Inspector also conducted the enquiry and submitted the report to the first respondent.

3. The grievance of the petitioner is that the first respondent inspite of the receipt of the report, has not passed any orders till date. Therefore, the petitioner is before this Court seeking for an appropriate direction.

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the first respondent to pass orders on the application submitted by the petitioner on 08.05.2015, strictly in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The first respondent shall issue notice to the petitioner and the fourth respondent and give them opportunity before passing final orders. The petitioner shall make a fresh representation to the first respondent along with all the relevant documents and also the copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
