(CRIME NO.136/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition, order in Crl.O.P.No.10716/2021 order dated 22.06.2021 para No.5 (e) the petitioner shall report before the respondent police daily at 10.30 pm until further order modified that the petitioner shall appear before the Learned Judicial Magistrate Court, Thittakudi.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.ESAKKIMUTHU, Advocate for the petitioner, and of M/S.C.E.PRATAP, Govt. Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:-

ORDER

(The case has been heard through video conference) The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.5 Clause (e) of the order dated 22.06.2021 passed by this Court in Crl.O.P.No.10716 of 2021.

2. This Court vide order dated 22.06.2021 in Crl.OP.No.10716 of 2021, while granting bail to the petitioner/accused, imposed the aforesaid conditions.

3. The learned counsel for the petitioner has submitted that one of the conditions imposed on the petitioner is that he shall report before the respondent police every day at 10.30 a.m., until further orders and he further submits that the above said condition may be modified to that effect directing the petitioner to appear before the learned Judicial Magistrate Court, Thittakudi.

4. Considering the fact that this court vide order dated 22.06.2021 had directed the petitioner to appear before the respondent police daily at 10.30am., considering the nature of offence and also in view of the present pandemic situation. Once a condition has been imposed by this court for certain reasons, without sufficient cause and reason, seeking modification of the order is impermissable. In such view of the matter, there being no sufficient cause, the present petition is dismissed.
