K.Gunasekar ... Respondent This case is taken up for settlement before the National Lok Adalat. Mr.M.Aswin, learned counsel for the petitioner and Mr.B.Srinivasan, learned counsel for the Respondent are present before this Court.
TERMS OF SETTLEMENT The respondent K.Gunasekar filed a complaint before the Fast Track Court, Tiruvallur alleging that the revision petitioner herein has committed an offence of dishonour of cheque for a sum of Rs.6,00,000/-. 2.The Fast Tract Court passed an order directing the revision petitioner to pay compensation of Rs.6,00,000/- being the amount due upon the cheque and was also convicted and sentence to undergo 6 months simple imprisonment.
3.The revision petitioner has challenged the above order passed by the Fast Tract Court before the First Additional District Court. The First Additional District Court confirming the order passed by the Fast Track Court.
4.The revision petitioner has preferred the Criminal Revision before the Hon'ble High Court challenging the above order passed by the Fast Tract Court as well as by the appellate Court. 5.Both the parties having initiated negotiation and compromised all the issues arise under the case.
6.The revision petitioner having agreed to pay a sum of Rs.6,00,000/- to the respondent, paid the entire amount to the respondent.
7.The respondent having agreed to the terms and conditions of the
compromise received the said amount from the revision petitioner herein. 8.As a result, in view of the above compromise between the parties and the payment of the cheque amount by the revision petitioner to the respondent, the orders passed by the Fast Track Court as well as by the Appellate Court stands set aside and the revision filed by the petitioner herein stands disposed of.
9.The Court fee paid by the petitioner to be refunded. Selvam ...Revision Petitioner K.Gunasekar ... Respondent This Lok Adalat award is passed in terms of the above settlement. The full Court fees paid shall be refunded to the parties in the manner provided under Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
