Respondent Petition filed under Section 482 of the Criminal Procedure Code, to direct the respondent not to harass the petitioner, being a housewife, in connection with the enquiry in Cr.No.779 of 2008 and further direct the respondent to proceed with the enquiry along with the statement already recorded from the petitioner and the documents already collected by the CCB, Madras in January 2009 itself.

O R D E R

The petitioner has filed this Criminal Original Petition for a direction to the respondent not to harass the petitioner in connection with Cr.No.779 of 2008, registered against her husband viz., Mr.Shivakumar.

2. The learned Government Advocate (Crl.Side) submitted that now, the investigation has been over and final report has also been filed and the matter has been taken up and numbered as C.C.No.6502 of 2016, on the file of the Special Court for CCB, Allikulam, wherein, witnesses P.W.1 to P.W.8 were already examined and for examination of P.W.9 to P.W.11, the case was posted for trial on 30.08.2017. In view of the factual position and subsequent development, he says that the petition has become infructuous.

3. In view of the factual position as stated by the learned Government Advocate (Crl.Side), I find that the prayer in the https://hcservices.ecourts.gov.in/hcservices/

petition has become infructuous and accordingly, this criminal original petition is disposed of, with a direction to the concerned Magistrate to expedite the trial in accordance with law.
