ORDER

The petitioner was arrested on 26.02.2026, on execution of a NonBailable Warrant issued by the learned Sessions Judge, Magalir Neethi Mandram (Fast Track Mahila Court, Vellore), Vellore District for the offences under Sections 498(A), 302, 201 and 404 of IPC, pending trial in S.C.No.122 of

2015, in respect of Crime No.162 of 2014 on the file of the respondent police, seeks bail.

2. The petitioner is facing prosecution for the offence under Sections 498(A), 302, 201 and 404 of IPC. The case has been taken on file in S.C.No.122 of 2015 on the file of the learned Sessions Judge, Magalir Neethi Mandram (Fast Track Mahila Court, Vellore), Vellore District. The petitioner did not appear before the Court regularly and therefore a Non-Bailable Warrant (NBW) was issued on 04.11.2020. Subsequently, the petitioner was arrested by the respondent police and produced before the Trial Court on 26.02.2026.

3. The learned counsel for the petitioner submitted that the NBW was issued against the petitioner and the petitioner was arrested on 26.02.2026. He further submitted that the petitioner has been in incarceration for about two months and therefore prayed that the petitioner may be enlarged on bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent strongly opposed the bail application and submitted that a NonBailable Warrant was issued against the petitioner on 04.11.2020 and that he was secured only after a lapse of nearly six years, on 26.02.2026, He further submitted that the delay in conducting the trial was only due to the absence of the petitioner. He further submitted that the trial has now reached an advanced

stage and the Investigating Officer is presently in the witness box. Therefore, it is contended that if the petitioner is enlarged on bail, there is every possibility of further delay in the progress of the trial.

5. I have given my anxious consideration to the submissions made by the learned counsel appearing on either side and also perused the materials available on record.

6. Considering the above submissions, particularly the conduct of the petitioner in evading the process of law and the stage of the trial, this Court is of the firm view that it is not an appropriate stage to grant bail to the petitioner.
