The present Miscellaneous petition has been filed seeking to condone the delay of 1183 days in filing the above Criminal Revision case.

2. Learned counsel for the petitioner submitted that, without prejudice to his rights, the petitioner is ready to deposit the entire cheque amount within the time stipulated by this Court and accordingly, he prayed for condoning the delay of 1183 days in filing the above criminal revision.

3. In view of the fair stand taken by the learned counsel for the petitioner, this Court directs the petitioner to deposit the entire cheque amount to the credit of CC.No.13606 of 2008 on the file of the Metropolitan Magistrate, Fast Track Court No.2, Egmore, Allikulam, Chennai within a period of two weeks from the date of receipt of a copy of this order. Upon production of necessary proof by the petitioner with regard to deposit of the entire cheque amount as ordered by this Court, Registry is directed to number the criminal revision, if the papers are otherwise in order and post the main case for admission.
