K.Ramesh, v. The District Collector,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 30.10.2017 CORAM :
THE HONOURABLE Mr.JUSTICE T.RAJA W.P.No.27715 of 2017 K.Ramesh ... Petitioner Vs.
1.The District Collector, Vellore District.
2.The Sub-Collector, Thiruppattur Taluk, Vellore District.
3.The Tahsildar, Taluk Office, Thiruppattur, Vellore District.
... Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to dispose of the petitioner's representation dated 06.10.2017 by giving him an appointment order for the post of Village Assistant to the Village Administrative Officer in pursuance of the call letter bearing Ref.No.Na.Ka.A3/6499/2017, dated 05.09.2017, issued by the 3rd respondent. For Petitioner : Mr.V.Chinnasamy For Respondents : Mr.P.Sanjay Gandhi, AGP
ORDER
Mr.P.Sanjay Gandhi, learned Additional Government Pleader, took notice for the respondents.
2.The petitioner has come forward with the present writ petition praying to direct the respondents to consider his representation dated 06.10.2017 seeking appointment in the post of Village Assistant.
3.The petitioner was issued with a call letter by the 3rd respondent and the petitioner also took part in the interview https://hcservices.ecourts.gov.in/hcservices/
held on 14.09.2017. Admittedly, till date no selection list was announced or declared. While so, it is absolutely unjustified on the part of the petitioner to rush to this Court seeking for a mandamus directing the respondents to consider his representation and to appoint him in the post of Village Assistant. When the 3rd respondent, appointing authority, has to consider the candidatures based on the merits, the petitioner has to wait till the declaration of the select list. The writ petition is therefore premature and the same is liable to be dismissed.
Accordingly, the writ petition is dismissed. No costs. Assistant Registrar Dt.15.11.17 //True Copy// Sub Assistant Registrar To 1.The District Collector, Vellore District.
