This petition has been filed to direct the respondents to comply with the order dated 16.11.2023 in Crl.M.P.No.6087 of 2023 passed by the learned Judicial Magistrate No.1, Namakkal.

2. Heard the learned counsel for both sides and perused the materials available on record.

3. On a perusal of the order dated 16.11.2023 in Crl.M.P.No.6087 of 2023, it is revealed that the learned Judicial Magistrate No.1, Namakkal. directed the first respondent to conduct an enquiry in the light of the directions issued by this Court in Sugesan Transport Private Limited -vsAssistant Commissioner of Police, Chennai reported in (2016-5 CTC -

577) and file a report. However, so far, the first respondent did not conduct any enquiry and failed to comply with the order passed by the Trial Court. 2/4

4. In view of the above, the first respondent is directed to register the First Information Report forthwith, as directed by the Judicial Magistrate No.1, Namakkal in Crl.M.P.No.6087 of 2023 and proceed with the investigation against the accused.

5. With the above directions, this Criminal Original Petition is disposed of.
