ORDER

This petition has been filed to modify the condition imposed on the petitioner by an order dated 01.06.2022 in Crl.M.P.No.1452 of 2022 by the Principal Sessions Judge, Erode, to report before the Inspector of Police, Sathyamangalam Police Station daily at 10.00 a.m and sign for a period of 30 days. 2.The petitioner was granted anticipatory bail in Crime No.48 of 2022 registered for the offence under Sections 147, 341, 447, 294(b), 506(ii) of IPC, in Crl.M.P.No.1452 of 2022 order dated 01.06.2022 with the following conditions: (i) that the photographs and left thumb impressions of the sureties be affixed in the surety bond;

(ii) that a copy of their aadhar card/voter identity card/bank pass book of the sureties be furnished for their identity,

(iii) that the cell phone numbers of the sureties and of the petitioners/A1 to A5 be furnished.

(iv) that the petitioners/A1 to A5 shall not enter in any way into Perundurai Taluk until further orders but subject to the condition (vii), (v) that the petitioners/A1 to A5 shall stay in Sathyamangalam Town and shall not leave Sathyamangalam Town until further orders but subject to the condition (vii), (vi) that the petitioners/A1 to A5 shall report before the Inspector of Police, Sathyamangalam Police Station daily at 10.00 am and sign, for a period of 30 days and subject to further extension.

(vii) that the petitioners/A1 to A5 shall appear before the respondent police as and when required and shall co-operate for the investigation.

(viii) that the petitioners/A1 to A5 shall not in any way tamper the witnesses or the investigation.

3. The learned Counsel for the petitioners would submit that the petitioners are not having sufficient funds to stay at Sathyamangalam to report before the Inspector of Police, Sathyamangalam Police Station. Therefore, the petitioner prays for further modification.

4. Considering the facts and circumstances of the case, this Court is inclined to modify the conditions imposed by the Court below. Accordingly, the sixth condition imposed in the order dated 01.06.2022 in Crl.M.P.No.1452 of 2022 is modified as " (vi) that the petitioners/A1 to A5 shall report before the respondent police daily at 10.00 a.m for a period of 30 days" and subject to further extension. The other conditions imposed by the Court shall remain unaltered.
