Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents directing the respondents to conclude the Departmental Enquiry proceedings which is pending on the file of the 2nd respondent on the light of the proceedings of the 1st respondent in ROC No.1517/A/2015 dated 29.4.2015 as expeditiously as possible, within a stipulated period of time and to pay all the service and monetary benefits to the petitioner.

ORDER

(Order of the Court was delivered by SATISH K. AGNIHOTRI, J.) With consent, the writ petition is taken up for final disposal. The petitioner has come up with this writ petition seeking a direction to the respondents to conclude the Departmental Enquiry proceedings which is pending on the file of the 2nd respondent in the light of the proceedings of the 1st respondent in ROC No.1517/A/2015 dated 29.4.2015 as expeditiously as possible, within a stipulated period of time and to pay all the service and monetary benefits to him.

Learned counsel appearing for the petitioner submits that the petitioner has received the second show cause notice on 21.09.2015 and thus, he may be granted one week time to file his explanation/response to the said show cause notice and a direction may be issued to the disciplinary authority to consider and pass appropriate orders on the petitioner's explanation/response on merits and in accordance with law.

On the other hand, learned counsel appearing for the respondents submits that on receipt of the petitioner's explanation, consequential order will be passed within a period of three weeks. In view of the above said submissions, without expressing any opinion on the merits of the case, we permit the petitioner to submit his explanation within a period of one week from today and on receipt of the same, the respondents shall consider and pass appropriate orders on merits and in accordance with law, within a period of three weeks.
