ORDER

This Criminal Original Petition has been filed seeking a direction to transfer the case in Cr.No.3628 of 2015 on the file of Inspector of Police, R1, Mambalam Police Station, Chennai, the second respondent herein to some other agency.

2. The learned Additional Public Prosecutor appearing for the respondents has submitted that after registration of the FIR in Cr.No.3628 of 2015 for the offence under Section 380 of IPC, the second respondent conducted an investigation and it was closed on 22.12.2016 as "further action dropped". In fact, the Referred Charge Sheet was also filed by reference No.2130 of 2016 on the file of the XVII Metropolitan Magistrate, Saidapet, Chennai.

3. With the above submission, the transfer of investigation https://hcservices.ecourts.gov.in/hcservices/

would not arise since no investigation is pending on the file of the second respondent herein. However, the second respondent is directed to serve the copy of the Referred Charge Sheet afresh forthwith to the petitioner. On receipt of the same, the petitioner is at liberty to file a protest petition in the manner known to law, if so advised.

4. With the above direction, this Criminal Original Petition is disposed of.
