Application No.2587 of 2021 V.PARTHIBAN,J.

Seeking leave to institute suit against the respondents/ defendants 1 to 3, who are residing outside the jurisdiction of this Court, the applicants/plaintiffs have come up with this application.

2. The suit is filed for recovery of money.

3. Learned counsel for the applicant would submit that the respondents/defendants 1 to 3 were residing in Neelankarai which is outside the jurisdiction of this Court. He would further submit that all the other respondents reside within the jurisdiction of this Court and the major part of cause of action arisen is also within the jurisdiction of this Court. To avoid multiplicity of proceedings, leave is necessary to file a single suit in respect of the defendants 1 to 3, the learned counsel contended.

4. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
