PRAYER: Criminal Original Petition is filed under Section 439(b) of Cr.P.C. praying to modify one of the condition to deposit the original document of the property worth Rs.23,00,000/- which would to be retained by the Judicial Magistrate No.II, Tiruppur subject to the outcome of the litigation in the order passed by learned Principal Sessions Judge, Tiruppur in Cr.M.P.No.873 of 2024 dated 29.04.2024. ORDER

Criminal Original Petition has been filed to modify one of the condition to deposit the original document of the property worth Rs.23,00,000/- which would to be retained by the Judicial Magistrate No.II, Tiruppur subject to the outcome of the litigation in the order passed by learned Principal Sessions Judge, Tiruppur in Cr.M.P.No.873 of 2024 dated 29.04.2024.

2. Learned counsel for the petitioner would submit that he is not in a position to deposit the original document of the property which is worth about Rs.23,00,000/- and he is ready to deposit a sum of Rs.5,00,000/- to the credit of the Crime Number.

3. Considering the said submission, I am of the opinion that the said modification can be sought from the Court below. In view of the same, liberty is granted to the petitioner to approach the Court below, to seek for modification of the order passed in Cr.M.P.No.873 of 2024 on 29.04.2024.
