ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 296(b), 78 (1) (ii), 351 (2) of BNS 2023 and Section 67 of the Information Technology Act, 2000 in Crime No.16 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the defacto-complainant was working as Assistant in the petitioner's Computer Centre. During the course of her employment, the petitioner developed love affair with her and they were taken photos together. After sometime, the defactocomplainant came to know that the petitioner is a married person. Thereafter, she stopped her relationship and she got married to another person. On 30.12.2024, the petitioner went to her house and compelled her to continue her relationship with him and also uploaded the photos taken by them in the social media. Hence the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner. 5.Head the learned counsels on either side and perused the records.

6.Suppressing the fact that petitioner is already married, he fell in love with the victim girl. Thereafter, they had relationship and taken photographs jointly. After knowing the fact that the petitioner is already a married person, the victim girl did not have any contact with the petitioner. Thereafter, on showing photographs, the petitioner threatened the victim and also threatened that it will be posted in the social media. Therefore, the petitioner has committed very serious and heinous offence as against the victim girl and the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 23-06-2025 ep
