ORDER

This petition is filed for a direction to the second respondent not to harass the petitioner in any manner except by due process of law pursuant to the representation given by the petitioner on 27.11.2015.

2.The learned counsel appearing for the petitioner submitted that the petitioner herein is engaged in the Lorry Transport business and for urgent business needs, he borrowed a sum of Rs.3 Lakh from one Shanmugam and the petitioner had repaid the entire amount along with interest. But the said Shanmugam has lodged a complaint with the second respondent and the second respondent is calling the petitioner frequently and harassing the petitioner under

the guise of investigation and prayed for appropriate orders. 3.The learned Additional Public Prosecutor submitted that based on the complaint lodged against the petitioner, the second respondent called him for enquiry and inorder to avoid the enquiry, the petitioner has filed this petition.

4.Irrespective of the submissions made on either side, this Court is constrained to pass the following order: (i) The petitioner is directed to cooperate with the enquiry.

(ii) The second respondent police is directed to conduct the enquiry in accordance with law, without harassing the petitioner.
