ORDER

This Writ Petition has been filed seeking for issuance of a Mandamus, to direct the respondents 1 and 2 to consider the claim of the petitioner for payment of remaining amount of Rs.1,25,263/- towards medical reimbursement for treatment from 12.07.2015 to 21.07.2015 in Ganga Medical Centre & Hospital (P), Coimbatore-43, and remit the amount to him.

2.The facts of the case are that the petitioner met with an accident and he was treated in Ganga Medical Centre and Hospital (P) Ltd., Coimbatore. After undergoing treatment, he was discharged on 31.07.2015. According to the petitioner, he incurred medical expenditure of Rs.1,50,570/-, which was paid to the hospital and in addition to the said expenditure, he also incurred a sum of Rs.22,693/- towards medicines etc. All the expenditure 2/5

incurred is a sum of Rs.1,73,263/-. The petitioner is a subscriber of Tamil Nadu Government Pensioners Health Fund Scheme,1995 by paying the prescribed subscription amount. Accordingly, the claim was made. The second respondent had only paid an amount of Rs.48,000/- and failed to pay the remaining amount of Rs,1,25,263/-. Hence the Writ Petition. 3.The learned counsel appearing on behalf of the first and second respondents, would submit that the original bills were not provided and secondly, the claim can be made before the District Level Empowered Committee.

4.However, the learned counsel for the petitioner would submit that all the original bills have been handed over to the fourth respondent. The petitioner shall make a claim before the District Level Empowered Committee by making a representation along with the photocopies of the expenditure that was incurred by him, the second respondent shall consider and disburse the remaining amount after due enquiry. The said process shall be concluded within a period of eight(8) weeks from the date of receipt of a copy of this order.
