Mr.R.Rajeshwaran, learned Special Government Pleader takes notice for the respondents. By consent, the main Writ Petition is taken up for disposal at the admission stage itself.
2.The petitioner has filed the above Writ Petition to issue a writ of Mandamus directing the first respondent to
consider the appeal dated 09.05.2017 and consequently direct the 1st respondent to issue necessary direction to the respondents 2 to 5 to cancel the conditional assignment order No.814, dated 05.12.1994 issued by the 5th respondent in proceedings No.86/1410 dated 13.03.2001.
3. The petitioner appearing in person, aged about 90 years old, submitted that the appeal filed by him before the first respondent is still pending. Further, the petitioner submitted that the first respondent may be directed to dispose of the appeal at the earliest, in accordance with law.
4. Mr.R.Rajeshwaran, learned Special Government Pleader appearing for the respondents submitted that the first respondent may be directed to dispose of the appeal in a time frame.
5.In view of the submissions made by the petitioner as well as the learned Special Government Pleader, taking into consideration the limited prayer sought for in the Writ Petition, without expressing any opinion with regard to the merits of the case, I direct the first respondent to consider and dispose of the petitioner's appeal dated 09.05.2017, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
6.With these observations, the Writ Petition is disposed of. No costs.
