PRAYER:

Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to dispose the representations of the petitioners dated 03.07.2017 and 18.09.2017 by passing appropriate orders to measure and sub divide the lands in Survey Nos.72/1 and 74/1 of Pattanam Village, Sulur Taluk and issue separate Patta in favour of the petitioners within a time limit and pass appropriate orders.

Mr.P.Senthilvel, learned Government advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioners seek for a mandamus directing the second respondent to dispose the representations dated 03.07.2017 and 18.09.2017, wherein and whereby they sought for issuance of separate Patta in their favour in respect of Survey Nos.72/1 and 74/1 of Pattanam Village, Sulur Taluk.

4. The grievance of the petitioners before this Court, is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioners, as it is for the second respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the second respondent to consider the representations of the petitioners dated 03.07.2017 and 18.09.2017 and pass orders on the same on merits and in accordance with law, after giving due opportunity of hearing to the petitioners as well as the rival claimants, if any. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
