The second appeal in S.A.No.1212 of 2009, was dismissed as abated on 25.06.2021, as it was reported that the sole appellant had died on 30.07.2020.
2.The learned counsel on either side would agree that the appellant is not dead and the person who died was N.Parameshwari / first respondent. This has been explained in the affidavit and the reasons are genuine.
3. Mr.G.Krishnamurthy, learned counsel appearing on behalf of the respondents will agree that the appellant is alive and the reporting to the Court by the representing counsel for the respondents on 25.06.2021 was erroneous.
4. In the light of the above submissions, C.M.P.No.8674 of 2022 is allowed.
